I know in France it's definitely a fine to be pulled over for using a cell phone while driving (1000FF last I heard, but I don't know the effect on insurance points for this.) It's treated like not wearing seatbelts, in short a valid pretext to pull you over. They had a few high profile accidents and that was about what it took. It's still perfectly legal with a hands free kit and should remain so. With their love affair with statistics of all sorts over there, I'm surprised not to find any hard data on how many accidents have actually involved yakking on a "portable"... In any case, many of the roads leading to loss of individual freedoms contain the label Risk Free Society For All
