In this case, the complete statement was "We are going to cut off their air supply. Everything they’re selling, we’re going to give away for free." (http://www.msnbc.com/news/205641.asp?cp1=1) The legality of that particular tactic is what was at issue on trial. I certainly wouldn't want to get into an ethics debate with the bus people, though, where flacking for a stock you own is the only ethical thing to do, and anybody who says anything contrary is a "paided basher" or something.
