Then why would Intel not phrase it thusly? "With a properly implemented thermal solution, the TCC will not activate."

I once did some work on the 440BX. It has a throttling mechanism to prevent it from melting under theoritical conditions. No one knows if it ever kicked in.

I must conclude that Intel can't test every possible condition and no one knows if it might kick in under some conditions. This is not a bad thing, it is a good thing. Athlons just crash.
