Perhaps, but the repubs would need to get out in front on the race issue. In other words, make the threat of a rejection into a race issue even before the name is announced. Something like, "there are several great hispanic judges who have been denied an opportunity over the last 8 years, and we're going to select one." Make race the issue early and often.

The DemMafia would have trouble with that.
