Slowly but surely hospitals are closing their trauma centers/ERs for the very reason you cite.

In a free market health care system, the government would have to mandate that a hospital keep their ER open.

Note that this is also the reason the most low income people use the ER as their 'insurance'. This is a horribly inefficient system for healthcare. The Oregon system is in the right direction, but I have seen primarily criticism. the liklihood of a similar allocation system catching on nationwide is minimal.
