Hi Sun Tzu; The way I understand it, (which could very well wrong) Micron and Hyundai would still have to sue to get the fraud estoppel with respect to their own possible infringement.

One of the effects of Infineon's not asking for relief here is that the legal case will be thereby extended in time, to the extent that Rambus is able to get the Markman overturned. This is a bit of a change in behavior. Before, when the momentum was to Rambus' advantage, it was Rambus that was delaying proceedings and Infineon that was trying to get them done quickly. Now that the momentum is to the advantage of Infineon, it is interesting that Infineon doesn't seem so hot to get the appeals finished.
