In addition to previous reasons we went through, another thought occured to me. The judge in Micron's case decided to waite for Payne's judgement. I wondered that if Payne's decision becomes a significant factor in Micron's case and is later overturned, then Micron's win (assuming they win) will easily be overturned as well.

Whereas now, if Micron wins the case on their own (using whatever info they've gained from Infineon's) then even if Payne's decision is overturned, the Micron case stands. Which then Infineon can use to their advantage in the (possible) future rounds.

Next week should be interesting. Not only to see how the market reacts to this legal twist, but (more importantly IMO) to hear what Intel has to say in their mid Q CC.
