Not that I've ever seen. Mind you I don't do criminal defense work. But most consent laws are based upon an arbitrary assumption. The law mandates an age below which a minor is not perceived to be able to consent even if there is some form of consent involved. I believe its been lowered to 15 in NH and we are generally pretty conservative. You'd really have to have some sort of bright line rule to be fair.
