But I think in some states the issue can turn on the age difference between the minor and offender. Not that I've ever seen. Mind you I don't do criminal defense work. But most consent laws are based upon an arbitrary assumption. The law mandates an age below which a minor is not perceived to be able to consent even if there is some form of consent involved. I believe its been lowered to 15 in NH and we are generally pretty conservative. You'd really have to have some sort of bright line rule to be fair. JLA
