Establishing the right to affirm rather than swear was one of the first acts of Congress. Largely because of the Philadelphia Quaker contingent, since one way the English harrassed the Quakers was to make them swear oaths, whereas they followed the Biblical commandment to "swear not at all." Even if the Quakers had done nothing wrong, they could be tossed in jail for refusing to swear to their having done nothing wrong. And they were.

So they made sure that in this country, nobody could be punished for refusing to swear.
