I have heard this. My presumtion is that kill in this context means murder. I would defend one of my daughters against a rapist/murderer unto the death of either myself or the assailant. Do you think this commandment was refering to this situation?

The same book that this quote comes out of specifies many situations in which we as a society should not continue to allow such persons to live among us. I don't think prison was the option being refered to. If you are going to base your point of view from the Bible then do it. God makes it clear what parameters of the human condition we should consider within our struggle and when people have violated those parameters and we should no longer be dealing with them. If you believe, send them to judgement/justice. The choice of life or death has never been yours and never will/should be.
