I thought he might try the "cruel and unusual" gimmick, claiming he suffered because of the FBI, etc.

I agree with the judges ruling, the guilt is not in question here... the guilt and the FBI omission of evidence are two separate issues and neither, it seems, would change or influence the other... at least, this has been the prevailing argument.....
