Appeals Court allow for a much better and detailed review. The Supreme Court would want the input from the Appeals Court in addition to what Jackson had to say.

What you should be asking is-- why Jackson tried to create some national emergency on this case. He tried to pull a fast one on justice, imho.
Fear of being overturned repeatedly by the same high court....an attempt to decrease the scrutiny of his decisions.

One also wonders why the Supreme Court did not take the case. Since they concluded it was not that urgent, one has to question why Jackson did...I keep coming back to Jackson's fear of Appeals Court review.

Because they knew that the appeals court was most likely leaning in favor of MSFT and that with a favorable ruling at that level the entire process might be done with.

It is possible that the ruling about to be announced will entirely end this debacle. The DOJ is unlikely to pursue it to the SC and the states will drop their bluff and the case too.

Because the case had not sufficiently vetted by the lower courts. The supremes agreed to that. That showed to me that msft acted wisely. Stop being a sourpuss and hide behind jackson's skirt.
