Uniformity is preferable, but not strictly necessary, since the question is not one of equity, but balancing the concerns of justice against the concerns of mercy, which is subject to reasonable disagreement.

It is reasonable for the state to fear civil disobedience, but its own actions may encourage it.

The Ten Commandments do not address any of these questions. if the administration of justice is in the hands of Caesar, and justice demands the forfeiture of life, than yes, our lives belong to Caesar, under certain conditions, when we break the law........
