David - Acknowledged that this is not unique to energy trusts, it is a brokerage/insider phenomenon that can be applicable to any security. Energy trusts have just been the vehicle for three of the more recent ripoffs.

Buying after the fact only works if you're not already long. No one gets to go back and undo the trades they made before the disclosures were made.

Of course, excusing the issuer assumes that the individuals connected with the trusts themselves didn't join in on the looting - it's very difficult to know whether they did or didn't in this case without some effort being put forth on the part of the regulators.

My guess is our seeing that happen is about as likely as seeing a mule win the Kentucky Derby.
