"I took Mr. Zdasiuk's deposition (Exhibit 1) last on November 11, 1999, long before he filed his Third Amended Complaint. Mr. Zdasiuk is probably the worse witness I can ever recall seeing at a deposition. By that I mean he repeatedly looked over to his counsel before answering any pointed questions, repeatedly looked over to his counsel for approval of his testimony, repeatedly took long breaks before answering tough questions (p119, 128 & 136), and squirmed and delayed repeatedly when giving his answers, was evasive, illusive, delaying, and non-responsive to my questions. As an example, the transcript notes (at page 115/11-13) that it took 23 minutes just to get a straight answer from Mr. Zdasiuk as to whether or not he is actually overweight (he claims in his lawsuit he was libeled for being called "fat," "overweight," or "fatso"). The cold, type-written transcript does not reveal the antics of this witness, or the aid he attempted to get from his counsel, and does not do justice to the mannerism differences displayed by Mr. Zdasiuk's face and movements when he answered "easy" questions compared to those questions going to meat of his accusations against my client. Of the 918 questions asked him, Zdasiuk only answered 673 of them (public record portion). Of those answered, Mr. Zdasiuk asserted responses of "I don't recall" approximately 125 times, "I don't know" 97 times, and "I don't remember" 25 times. Moreover, his counsel's role there seemed to be mainly to delay and slow down the deposition by repeated objections (approximately 178 objections appear in the "public portion of the transcript, alone. That is about one per page) and 14 instructions not to answer the pending question. "
