It has been challenged in the courts over the years. Federal judges find against the plaintiffs for various obscure reasons. It has been appealed all the way to the Supreme Court on several occasions, but each time the Supreme Court has refused to hear the case. Most Americans are totally unaware of this. They are also unaware that the system is supposed to be entirely voluntary and that payroll deduction was originally created as a temporary emergency measure during WWII.
