That's an incorrect statement on a number of counts. You may recall this earlier passage...

It considers the right to travel, assemble, and speak; the absence of forced labor, torture and other extreme legal punishment (such as the death penalty); freedom of political opposition, the press and trade unions; an independent judiciary; gender equality; and the legal right to trial, counsel of choice, privacy, religion and sexual practice."

The UN Human Freedom Index is not a questionnaire. Some of the factors are may be partially subjective, but it is largely statistical. Second, it would be quite difficult to extend the factor of "trade unions", "religion" and "sexual practice" to the point or argument of the death penalty.

Your earlier notation of the death penalty being "N/A" was quite clear. The Illinois situation is relevent to aspects of the Freedom Index other than the death penalty.

I would probably just answer the question about Illinois myself, but I'm finding it very interesting that you continue to avoid just answering the question. It appears that you prefer to avoid facts as necessary to support your opinion.
