I would like your opinion....Is there any justification (other than free market, which may be enough) for lawyers to get a high (30-40%) percentage on large tort awards? I am thinking about this patients bill of rights and wonder why the lawyers can make an almost unlimited amount on judgements yet the doctors who may save your life have their payments capped, and relatively small at that. Does the lawyer that wins a large suit really contribute more than the doctor? I think another flaw is that punative awards should not go to the plaintive. If the purpose is to punish the defendant, why does the plaintiff benefit? No cap on punative but let the entire punative award go into a general government fund.
