I doubt that this Pico Turbo ruling will have much, if any, impact on RMBS even if we assume it resulted from a Markman hearing.

My theory is that the patent system is the greatest of all legal "scams" expressly designed to take advantage of the inability of you wingless creatures to interact in a peaceful manner. When people stop paying their legal bills on mass we will know that true Market "revolution" will soon follow. <vbg> Until then, we can only watch and wonder at the "mysteries" of The Law.

The Big Guys who actually control the means of production - and those of us who need their production - have sought to avoid pouring money into the Black Hole of Patent Law by supporting industry standards groups. But the Legal system cannot permit this effort to be successful and it will find ways to maintain its growth rate.

...Which is why we cannot predict, with certainty, what the Supreme Court will do with Festo or any other case they take. All that we can say for sure is that they want to declare some law. What that "law" is will be largely determined by their collective perception of what patent litigants should be allowed to fight over in court and its a rare day when the Supremes truly cut off an entire field of legal battle. But they also have to accept the realities of a patent process that has become, lets say, "just a tad" insane.

I predict a very "mysterious" final decision with a minimum of three separate opinions by the Court.<vbg>
