I most respect your opinion on this, and have appreciateed your posts on this topic.

As I stated, however, I am hopeful the Supreme Court hears the case.

There seems to be a possibilitty it might.

One of the best aspects of the district court's decision to return NW's licenses to them was the fact that the decision was unanimous. (3-0) This indicates the lack of a political element in their decision. This unanimity at the district court level mitigates against the Supreme Court reviewing the case.
Secondly, I don' think Michael Powell feels compelled to cover William Kennard's rear. Kennard's actions re: Nextel are looking pretty suspicious about now. This court loss doesn't have to be an FCC defeat but a William Kennard defeat. Remember, this is not Bill Clinton's FCC.

JGoren. Well said. In this country we chose have the rule of law rather than the rule of men. Kennard seemed to have a lot of trouble with this concept. If Michael Powell spends too much more effort defending Kennard's actions, the problem will become Powells -- not Kennards. Surely he isn't that dumb.
