Yes, I can understand given the type of case and all possibilities because I don't know who the hell to trust given some things I have seen... so I am not trusting anyone The scope and possibilities are why I am concerned about privilege. I wish to reiterate that you should caution people that anything said to you in correspondence is subject to discovery. This will prevent them from saying things to vent, or to help, or for whatever reason they are disclosing comments that should be considered part of work product but wont be because you cannot assert a privilege.
