MSFT for the spike; no further details yet.

I haven't seen any source officially say it's overturned, but if it is, I do imagine we get that New Vision predicted rally <g> In the meantime, we wait. . . and wait. . . and wait (just like in Casablanca)

Court Reverses Break-Up of Microsoft

WASHINGTON (AP) - A federal appeals court reversed the breakup of Microsoft Thursday and ordered that a new judge decide the landmark case. It was a major victory for the embattled software maker.

The appeals court ruled that U.S. District Judge Thomas Penfield Jackson improperly conducted himself in the case, leaving himself open to the appearance he was biased against Microsoft.

``We vacate the judgment on remedies, because the trial judge engaged in impermissible ex parte contacts by holding secret interviews with members of the media and made numerous offensive comments about Microsoft officials in public statements outside of the courtroom, giving rise to an appearance of partiality,'' the court said.

11:56 ET Microsoft (MSFT) 74.96 +3.82 halted: -- Update -- Sources at Merrill Lynch telling Briefing.com that Henry Blodget commented on the MSFT ruling: said that MSFT is not out of the legal woods yet, but that it was an unexpected positive that the court overturned the breakup remedy. Separately, we're hearing that Goldman Sachs commented that a new judge in the lower court (Jackson was dismissed from the case), makes a settlement is more likely.
