It's not? Ruling correctly doesn't matter?

Not compared to the appearance of impropriety created by such a large and blatant conflict of interest. This is why we don't allow judges to say "Never mind that the defendant is my brother, you can be sure that I will rule correctly."

This assertion doesn't really satisfy anybody (except the brother), especially after the judge has ruled for the defendant.
