But the "Law" is 98% political economy, i.e., "What rules can we impose that won't make them come shoot us?" <g> There is no other way to explain the "legalities" of moving between acceptance of things as diverse as slavery, separate but equal, Final Solutions, to protected classifications,... and likely back again if we wait long enough.<vbg> Thus my legal view in this situation is now and has always been informed by my personal perception that the only "friends" of RMBS are those who have future profits and losses at risk. Everyone else who knows them and cares enough to form an opinion seems to think they stink. I think the judiciary will get a whiff of the same aromas and act accordingly. And don't mistake the PTO response for that of "The Law." The PTO is the ultimate in bureaucracy by the Federales. The Prime Directive of these central authorities is to support the uniform and elephantine in all things corporate. ...Well, it worked in WWII didn't it? Judges are different. Although they too must bow to the Business of America, they also keep a finger in the wind to guard against Angry Villagers storming the walls. That is in fact their Prime Directive. Fortunately for us Busless Mom & Pops, MU, JEDEC and the industry folk cheering them on are very big Angry Villagers and INTC is no threat to stand guard at the wall.
