That's as good as any argument any I've heard <gg>.

Lay people debating the legal merits of the appeals court's ruling wouldn't seem to be very productive. There are already legions of highly trained over paid lawyers doing that non-productively, and coming to contradictory conclusions. It seems the courts have once again rendered an opinion that is as clear as mud, and the only certainty is that Mr. Softee will have many more years of litigation in its future. But it appears that their day to day behavior will be less constrained by the judicial system, so the important issue to assess is, will they be able to begin growing their businesses again?
