The state AGs are right in insisting that any settlement must prevent Microsoft from doing business as usual. And Microsoft is right in trying to avoid any such settlement, because they cannot justify their P/E if they have to play by the rules. That's why I don't believe they will settle.

Difficult though it may be for policymakers, Microsoft, MSFT bagholders, and the courts, it is desirable for this important antitrust case to wend its way to the Supreme Court's docket. There are important legal precedents that can be set by this case, that will not be set if a settlement is reached.
