Idiot. That's how they set up the conference. The House conference members will not pass a conference resolution unless it's modified to protect the public from the trial lawyers. The question is, to what degree? If the Senate Democrats stonewall the president, the bill never leaves conference. If they deal (and you can expect them to-a raw defense of trial lawyers would be far too transparent) then a modified bill goes to the president, and he signs it. Even the best modification at this point would not make me happy, as the trial lawyers would still get a lot of what they set out to grab. But tort reform is still coming. It will come in the election year instead of this year because next year Puff may not be able to find 51 votes to stop it. But if he does, the Republicans can nationalize the issue for the off-year election.

The key to these issues: EVERYBODY hates tort lawyers. The negative ad possibilities are, to say the least, low-hanging fruit...
