Re modem speeds, I believe you're talking about analog transmissions across voice lines. The standards for an analog voice circuit call for 64Kbps transmission with 8Kbps of that bandwidth reserved for signalling. The standard permits 30 year old switches to continue working on today's networks as well as 50 year old telephones to continue to function properly.

Should the North American standards ever evolve to all digital (local loop side as well as the trunk side), a whole lot of crap would be made obsolete and the 56Kb/64Kb limitation would vanish.
