I use "right" in an ordinary sense, to mean something one has claim to. A right need not be fundamental. In talking about legitimacy, I am merely saying that the government is entitled to make the decision to extend the right of universal education, and that it is a good decision derived from the primary role of the government in society. As I say in another post, the means and ends of the good pursued should be proportional, and the good pursued should be very hard to obtain through private action, as was the case at the time that Horace Mann began promoting public education.
