I agree with your use of "natural" (inalienable) rights and rights clearly defined or implied in the Declaration of Independence, the Constitution and the Bill of Rights, but courts are limited to interpreting rights. Creating rights by judicial fiat is a dangerous and immoral game... although I believe there is evidence from their rulings that some federal judges have attempted this. Also the government has had some success constricting or limiting rights through regulations.
