While the latency register doesn't reside on the controller, the hardware that writes the latency register does. This falls under the "method" definition inside the patents.

In addition, you will kindly note that Rambus has already released multiple press releases noting that various companies have agreed to pay Rambus royalties on SDRAM controllers.
