Lost world: Tuesday July 31, 6:09 pm Eastern Time Press Release SOURCE: Avant! Corporation Avant! Makes Announcement on Restitution Award FREMONT, Calif., July 31 /PRNewswire/ -- Avant! Corporation (Nasdaq: AVNT - news) announced that a Santa Clara County Superior court has fixed the total restitution amount to be paid to Cadence Design Systems in the People v. Avant! action at $195,399,855. On July 26, 2001, Avant! paid Cadence $100,000,000. Avant! will pay an additional $40,000,000 on August 1, 2001. Avant!'s current cash resources are not sufficient to pay the remaining amount at this time. Avant! and Cadence are discussing terms for Avant!'s payment of the remaining amount by January 15, 2002. Avant! is also seeking sources of additional funding with which to pay the remaining amount. Although there can be no assurance that Avant! will succeed in obtaining payment terms or sources of additional funding, Avant! believes that cash it will generate from ongoing operations and other sources of capital will be sufficient to pay the remaining amount by January 15, 2002. The court has not set a date for entering the final restitution order, and Cadence and Avant! have agreed to ask the court to defer entering the final restitution order pending the results of their discussions regarding terms for Avant!'s payment of the remaining restitution amount. Payment will be due in full upon the entry of the restitution order, unless the order sets a schedule for future payments or Cadence and Avant! work out other payment arrangements. If Avant! is required to pay immediately the remaining balance of the restitution amount, Avant!'s financial condition and present ability to finance its current level of business activity would be materially and adversely affected . Avant! has proposed a schedule that would allow it to make the last payment on the remaining amount by January 15, 2002. If this proposed schedule is accepted, Avant! believes that cash it will generate from ongoing operations and other sources of capital will be sufficient to make the required payments. ...
