I do not know if the rackteering charge by Feds will stand. In many ways, Feds is a partner with tobacco companies. You know that Feds used to hand out tobacco to military service man for free. In addition, it has actively taxed the tobacco for many years. To say the companies are crime organizations which operate in public, subject various regulations, and, moreover, are taxed heavy seems to contradict to common sense. The the suit filed by Feds is very weak before it even started. When Clinton first asked DOJ to file the suit, the guy who was in charge at the DOJ for this task at the time was the (ex-)husband of Al Gore's sister. Gore's sister was a heavy smoker and had died from lung cancer before that time. You would think this guy at DOJ would really love to file the suit. However, he did not because he thought government did not have legal basis for the suit. The DOJ's suit was not filed until this guy left his position. Of course, government can charge the rule in the middle of the game. But, you got to remember what G. W. said during his election campain.

The slide in big MO's share price may have something to do with the recent loss in Los Angeles, the strength of the US dollar and general nerviousness of the market. By the way, there is an article today on Los Angeles Times about big MO's appeal: latimes.com
