Sorry, I was using the term to cover all kinds of sex outside of marriage, including pre- marital sex. I agree that a vow should constrain one if nothing else does, but there are circumstances, for example, when one's spouse has already violated the vow, or when people are separated and in the process of divorce, which, although iffy, are not in the same league as mere indifference to marital vows.

Of course, we can agree to have an open marriage.

And that's one of the best reasons that a marriage is not a suitable basis for the "legitimacy" of sex. Marriage contracts don't mean the same thing in all cases.
