I don't love or hate US vs Miller. It's a decision, that's all it is, an important one, but just a decision.

Actually, the worst possilbe case, IMO, is if US vs. Emerson is upheld and US vs. Miller is not overturned.[Unfortunately, I don't think that the Court would overturn US vs. Miller by upholding US vs. Emerson.]

In other words, I'm not keen on the idea that the USSC would end up validating an individual right to have nuclear weapons [or biological or chemical, or fully equipped F-16s and cruise missiles], which I think is what you have if US vs. Emerson is upheld and US vs. Miller is not overturned. I'm sure that sounds a over the top, but that's what I think happens. I can't read the two decisions together any other way, as much as I'd like to.
