Adhering to their own principles instead of traducing them would have also been a reasonable course. This court has regularly let state courts' rulings stand even if it thinks they have ruled unfairly or wrongfully -- even in capital punishment cases, even when the state courts ruled on federal law, not state law.

It's not even as if there was much danger of Gore becoming President; if two slates of electors had ever gone to the House, the Republican controlled house would have picked Bush. Moreover, the House of Representatives is the body the Constitution says should settle a contested Presidential election. Not the Supreme Court. Hasn't it been a long-standing principle of this court to respect the intentions of the Framers and avoid judicial activism?
