JC - My guess Tricky Europeans will be lobbying hard from every direction here. A total win for Next Wave would not be helpful to the GSM'ers.

FCC's Powell sees no need to expend any political capital by taking an unpopular (w/ the big boys on one side and little Nextwave on the other) stand in favor of Nextwave when the Supreme Court will most likely sustain the Appeals Court. Powel didn't cause the problem -- it just landed in his lap with a mountain of political liability attached to his taking any decisive action. After all, someday he can be a Senator or Nextel director or better if he doesn't piss off any important people.
