Having them deliberately "run out the clock" just helps to justify a more radical remedy when that day ultimately comes, IMHO.

At worst the appeal will be denied after 30+ days which simply helps run out the clock to the XP launch. But if the Supreme Court accepts the case then the risks to the government's case are very high since the question to be decided will revolve around Judge Jackson's apparent bias and how this may have tainted the trial phase of the case.

The high risk to the government's position if the Supreme Court accepts the case could possibly motivate a few hard line State AGs to settle on reasonable terms.

They are making the best argument they can. I would guess that the Supreme Court would take such a high profile case.
The judges won't even be asked to look into the complex issue of monopoly maintenance----that is a brilliant move on MSFT's part.
Give the judges an issue that they will find very interesting and very important. Avoid giving them issues that relate to the workings of computers, which could have required a lot of education that the judges may not be ready for.

All MSFT needs is for them to accept the case, and we could see a hasty settlement.

I bet the Supreme Court will accept this case. They must have been waiting for it. Who knows...we could get a taped hearings (just as in the election mess). <g>
To miss out on dealing with such a high profile case...not a chance! They had the case on their radar.

Reminds me of how quick the Appeals Court was to accept it even while Jackson was trying to push it past them! It was obvious they did not want to miss out.<g>
