I would be very surprised if a stay is granted from the Second Circuit; the court did not stay the auction because the FCC represented that it would give back the licenses to NW if it lost. The FCC has failed to live up to its representation to the Second Circuit. Litigants who use circumstances they engineered in the litigation to justify why they should be granted something as the status quo do not fare well in front of courts. Now, if the Supreme Court grants a stay, there is trouble. I think the bankruptcy court will proceed as quickly as possible and at that point the FCC will try to get a stay from the Supreme Court.
