Unfortunately, I think your scenerio is right on. There is no way that this case will go anywhere now.

I compare it to the fight against racism in the South. In the beginning, racists were overt and dumb. Later, they got smarter and subtler, and therefore harder to root out.

Bill and co. now know the bounds and will smartly make sure they still just this side of it. No more "if you put anyone else's browser icon on the desktop, we won't sell you OSs". Now, it's "if anyone else gets an icon, we do too". A clever non-difference.

This fight is lost. SUNW should concentrate on keeping the high-end server market and let Larry E. waste the billions mudslinging at Bill.
