I don't know until he starts behaving in some way, or saying certain things, that he's gay. If I then discriminate against him, it's not because of his attributes but because of his behavior.

Chris, I think you're wrong about this. If someone is "behaving gay," by which I assume you mean stereotypical dress or mannerisms, if you discriminate against him, you're still doing so be is is gay. There was a local case where a black woman was fired for wearing corn rows and she won. To fire someone legitimately for "behaving gay," he would have to be doing something lewd and indecent, in which case it wouldn't matter if he were gay or not.
