That's exactly what is the direction the market is trying to go. Treating software as int. pro rather than patent it.

Another point -that touches the law of increasing returns- we have discussed here with CB is the fact that if in the surface of it MSFT kills everyone in sight that compete with it, MSFT domination of OS and Intel of the microprocessors -and we don't see the US government trying to break up Intel- have in fact increased the returns in the computer industry.

Which is not necessary a benevolent thing out of MSFT but when we look to the world economy as a whole it was beneficial to have this monopoly.

I know the purists will not like that, but if Africans Asians and other less developed countries can benefit of cheaper prices this is positive in my opinion. Compare for instance with Apple Computer proprietary system raking in the cash from the afficcionados...
