I don't know if it is fair, but in both cases, should we bring in the families and let them decide?

State laws are different. I always jump on those that blame GWB for the death penalty being carried out, but when it gets right down to it, I will support a life without parole, if it is punishment and not just a home in the local country club jail, where he/she could smoke, watch tv, lay around, etc.

Of course as I have always said, I may not think the same thing if it was MY wife or family killed.

I believe you need a constitutional amendment to abolish the death penalty.

Nevada has no state income tax, is that fair? Vermont has almost no restrictions on concealed carry of a handgun, is that fair? Parts of Santa Monica have living wage laws of $10.25 an hour and right across the street it's $5.25, is that fair?

As to your original question, it would be fair if both states had capital punishment and even more fair if they both had choices of life with NO parole and life with the possibility of parole IMHO. It's hard to righteously blame either though.
