You may be right. I have little experience in law myself, but my argument with Albert has been more towards the ethical sides of this issue. Albert believes that Intel has been threatening their customers with law suites, while I tried to explain it as a warning against liability, which may arise under certain conditions.

"But the warning of those manufacturers makes me suspect that Intel feels they don't have a case... I suspect that Intel is very aware that VIA has a strong claim to the IP."

As I understand it, VIA's only claim to a Pentium 4 bus license is through the acquisition of S3. As far as I know, acquisitions don't necessarily guaranty a company all the trade agreements of the company they are acquiring. Consider Serverworks, who always worked very closely with Intel. Do you think that Broadcom has all the same benefits that Serverworks had before they were acquired?

Beyond this, I have no legal expertise, so your guess is as good as mine. One thing's for sure, and that is that Intel has a right to enact licenses for their own technology. Whether VIA needs a license, or whether they have one already is for a court to decide, but looking at things right now, I'd say that Intel has a stronger case than VIA does.
