I agree that the "hate crime" legislation is flawed. We have a law here in Colorado that allows us to add a degree of criminality to a crime against an "at risk" individual. It was primarily established to make it a more serious crime to hurt an elderly person, but accommodates other at risk individuals as well. Assault on an elderly person now becomes a felony. I can imagine coming from this, a series of laws that add a degree of criminality to crimes against someone in a protected status.
