I confused your discussion of the events of a year ago with the current, very similar, events. I believe someone (niceguy?) suggested Intel do that very thing (apologize to Via etc.). It wouldn't surprise me if the current case wound up just like the last one, although that certainly hasn't happened yet.

VIA's current claim is that through S3 they have a bus license from Intel. Intel disputes that. What is unclear to me is if VIA owned S3 last year when they settled with Intel in the original bus dispute. Looks like this one is headed to court.

EP
