Fraunhofer owns the patents on mpeg 1 level 3 encoding.
Everyone else either licenses it or uses modifications of the original ISO code (like Blade) which FH still claims is illegal. Lame gets around it by only providing source code while others convert that into *.exe and *.dll files.

Microsoft pushes there own Audio encoding scheme called WMA...which is pretty good on lower bitrates... 96 and below. More suitable for streaming.

MP3 is no where the best scheme...there are others like OggVorbis, AAC, even lossless compression like MonkeyAudio...but .mp3 is far and away the accepted audio compression...so that's what most everyone uses...

Kind of like VHS vs Beta...Beta was better but VHS was in the right place at the right time.
