SENATE JUDICIARY COMMITTEE "NOT INTERESTED" IN DRUG SMUGGLING TIES OF NEW DRUG ENFORCEMENT ADMINISTRATION CHIEF

An aide to Senator Patrick Leahy’s (D-Vt.) Senate Judiciary Committee said that the Committee is "not interested" in probing links to drug smugglers of Arkansas Rep. Asa Hutchinson in his confirmation hearing Tuesday to be the new head of America’s Drug Enforcement Administration.
"Its not our job to conduct any investigation into the matters you’ve brought up," Mary DeOreo told Daniel Hopsicker, author of a new book with damaging information about Hutchinson in a phone call Monday. The book, "Barry & ‘the boys’" (MadCowPress) due out in September, documents Hutchinson’s recent ties with one of Mena drug smuggler Barry Seal’s top operatives in the cocaine smuggling which took place while Hutchinson was US Attorney for the Western District of Arkansas, encompassing Mena.

"Asa Hutchinson has documented recent ties with one of the principals in Barry Seal's smuggling organization, Michael Roy Fugler, that operated with impunity while numerous law enforcement officials accused Hutchinson of doing nothing to stop it, and of, in fact, protecting the operation," Hopsicker stated.

"Its shocking that the Senate Judiciary Committee, which must approve Hutchinson’s nomination, is uninterested in the fact that Hutchinson became the "marketing poster boy" for a company recently taken public by a member of Seal’s drug ring."

The book quotes Arkansas State Police Commander, Finis Duvall, whose area included Mena, as saying that on at least one occasion then-US Attorney Asa Hutchinson ‘took care’ of a Mena legal entanglement for Barry Seal that has never been surfaced in the press. Duvall states the Arkansas State police didn't even try to develop a case against the Mena drug smuggling, because it was well known that it was being 'protected.' "We always knew we couldn't prosecute Barry Seal, no matter what we got on him, because of the politics involved in the Western Judicial District," said the former Arkansas State Police Commander, referring to Hutchinson.

"Barry & ‘the boys, The CIA, the Mob, and America’s Secret History" is the result of a three-year long investigation into Barry Seal, who government attorneys called the biggest drug smuggler in American history, contains revelations about Seal’s involvement with top officials in both major political parties, including Republican Attorney General Ed Meese, former Democratic National Chairman Charles Manatt, and Al Gore's campaign chairman Tony Coelho.

According to informed sources like Miami private investigator Gary McDaniel, "Every successful drug smuggling organization needs four things: "Production, distribution, transportation, and protection." George W. Bush’s nomination of Asa Hutchinson to head the Drug Enforcement Administration is a crushing blow to those who couldn’t bring themselves to believe the sordid stories of George Junior consorting with drug smuggler Barry Seal.

As reported in the new book "Barry & ‘the boys,’" and magazines and newsletters like "From the Wilderness" and "High Times," George the II had much more than a nodding acquaintance with the biggest drug smuggler in American history and his notorious Mena operation.

Instead of downplaying this connection while focusing all eyes on the tee-ball on the south lawn, Bush has now put it right in our faces. Current Republican Congressman and former Western Arkansas US Attorney Asa Hutchinson was directly involved in the Mena drug smuggling operation, providing the critical legal ‘protection’ necessary for any operation of that size and magnitude, and acting to squelch whatever legal action which local citizen outrage prompted.

In addition to the people already on record regarding Hutchinson’s coziness with the Mena cocaine smuggling—former IRS agent Bill Duncan prominent among them—numerous witnesses have stepped forward for the first time on Hutchinson in "Barry & ‘the boys."

According to the Arkansas State Police Commander in charge of Mena, Finis Duvall, on at least one occasion then-US Attorney Asa Hutchinson ‘took care’ of a Mena legal entanglement for Barry Seal that has never been surfaced in the press.

According to Duvall, who was there, the Arkansas state police didn't even try to develop a case against the Mena drug smuggling, because it was well known that it was being 'protected' by US attorney Hutchinson.

"We always knew we couldn't prosecute Barry Seal, no matter what we got on him, because of the politics involved in the Western Judicial District," the crusty Finis Duvall told us.

Then there are Hutchinson’s recent business dealings with drug smugglers. Recently a Barry Seal drug smuggling associate, Michael Roy Fugler, took a company called Netivation public. Netivation.com (NASDAQ: NTVN) portrays itself as an Internet public policy and political Web site, offering a package of fundraising services to candidates and campaigns. The Virginia State Democratic Party, for example, raised money for Netivation.com to produce Web sites for its candidates, and Netivation.com received a percentage of any campaign contribution made to candidates via the Web pages. It also publishes the US Congress Factbook, and has a major Internet site for campaign fundraising.

One question might be: what does a drug smuggler have to do with the US Congress Factbook? But wait...there’s more. After going public, Netivation turned around and immediately signed as their initial marketing "poster boy" none other than Arkansas Congressman Asa Hutchinson. Hutchinson, of course, before becoming the marketing "poster boy" for a company drug smuggler Barry Seal's associate Michael Fugler took public, had been the U.S. Attorney for the Western Judicial District in Arkansas, which encompasses Mena.

That’s enough for a grand jury, right there. It provides direct and concrete evidence that what's been called "the goings-on at Mena" reveal exactly what the "conspiracy theorists" have been loudly proclaiming for a decade: the visible efforts of a huge and largely invisible organization.

Paying off a favor isn’t, of course, illegal.

But abetting drug smuggling, unfortunately for Mr. Hutchinson, is.

This is no small matter, especially since Michael Fugler was no mere legal counsel to Barry Seal; rather, he was an integral part of the smuggling organization, and already, by the middle Seventies, deeply involved in all of Barry’s various businesses, including the 'front' sign companies.

We had heard from several of Seal's associates accounts of Fugler's activities which the State Bar of Louisiana would presumably frown on…Like the time he had left a briefcase filled with over $100,000 of drug money sitting on the front car seat of a rental car at Baton Rouge Airport, and then been too afraid to go back to attempt to retrieve it.

Congressman Hutchinson has the sheer gall to serve as a member of the House Speaker's Task Force for a Drug-Free America. As what? An industry representative?

The Task Force has a mandate "to seek out new and more effective approaches to combating the threat of drug use among the nation's youth."

Numerous witnesses in western Arkansas can be found who can directly testify that Mr. Hutchinson’s actions, as opposed to his words, have been absolutely and unequivocally detrimental to achieving this goal.

As an aside, Hutchinson somehow also found the time to present the case to the Senate for the impeachment of Bill Clinton, where he urged the senators in his closing argument to "let justice roll down like mighty waters." Were that to happen, we would urge Asa not to wear his good suit to work that day, because Clinton wouldn’t be the only one getting wet.

Hutchinson made tough-talking speeches to community groups in Arkansas about cleaning up what even he had been forced to acknowledge was "a haven for international drug trafficking" Barry Seal had continued to operate from an airfield, Mena, just a few short miles from Hutchinson's office.

Maybe the sound of the big C123’s rumbling overhead had scared him. But obserbers of Hutchinson’s lack of performance grew increasingly skeptical of their boys’ fire-eatin’ crime-fightin’ credentials.

Hutchinson's actions never once matched his rhetoric.

IRS agent William Duncan had been the first to take his accusations public. In a deposition for the Arkansas Attorney General, he was asked, "Are you stating now under oath that you believe that the investigation in and around the Mena airport of money laundering was covered up by the U.S. Attorney?"

Duncan's reply: "It was covered up."

Now we know why.

By following the money trail left behind by Barry Seal, we have now discovered that more than a dozen years after Seal's death one of the key members of his drug smuggling organization brought a company public which had then signed on Asa Hutchinson to be the poster boy for its marketing efforts to attract fundraising clients.

Cautionary Tale Of A Little Stock Called Ziasun And Big Losses (Part 1)

Small Ziasun Technologies Inc. appears to be the familiar tale of Internet stocks, which rocketed in price on favorable news only to come back to earth after some of that news' accuracy was questioned. The tale of Ziasun underlies how hard it can be for investors to track some companies' financial prospects, and to discern the financial backing of some fledgling Internet firms.

At the heart of the Ziasun story is a convicted drug dealer and con man named Regis Possino, whose name has shown up in numerous court regulatory filings and other documents as a consultant and shareholder in numerous companies. Further evidence that there might be a widespread conspiracy to defraud investors is provided by the fact that Regis Possino, a disbarred California attorney Apart from disbarment in 1984, Possino's history includes being imprisoned for one year in 1978 for trying to sell $38,500 worth of marijuana to undercover Los Angeles cops, trying to place a monthly order for $680,000 worth of cocaine with the same officers, attempting to sell $5 million of stolen US treasury bills or bearer bonds to an undercover treasury agent, undergoing a $12 million personal bankruptcy and interfering with a witness at his trial on the marijuana offense, leading to her dismissal from the jury and his imprisonment for the rest of his trial. "One evening during the trial, petitioner encountered one of the trial jurors as she was waiting for a table at a restaurant," reads the official record of his appeal against disbarment. "He approached her, initiated a conversation and bought drinks for her and her companions. Although they did not discuss the merits of the case, petitioner asked the juror what she thought of the prosecutor. He also talked to her about himself, other persons involved in the trial and the judge. Learning that the juror was a religious person, petitioner discussed his own religious beliefs with her. The conversation ended when the juror and her friends were called to dinner." Details of all of the above, with the exception of his bankruptcy, which was closed in 1992 with assets of $229,000 and liabilities of $12.18 million, were presented to the California Bar Association at his appeal against disbarment. Although Possino's appeal against disbarment was thrown out, three of the eight members of the panel voted against disbarment and thought his license should only be suspended for five years!

So I know everyone wants to know what Regis Possino's connection to Ziasun could possibly be. The answer can be found in one of the buy reports that Mark Bergman of Access1Financial put out on Ziasun. In the disclaimer of the report it states "The author(s) may have positions in the stock or financial relationships with the company discussed and may trade in the stock mentioned." What Access1financial failed to state in the disclaimer is the firm that was faxing out and promoting the stock was "Corporate Financial Enterprises." Its right on the cover sheet that they faxed me located at 2224 Main Street, San Monica, CA 90405. Further evidence of a conspiracy to defraud is that the same address appears on the Access1financal buy report for Ziasun. Regis Possino operated out of a former art gallery not far from the Pacific Ocean, on a commercial strip in Santa Monica, CA. Corporate Financial Enterprises, Inc. is a private investment banking and consulting firm owned by Mr. Regis Possino

John R. Emshwiller reported in the Wall Street Journal that according to Stuart Allen, a retired SEC investigator who helped investigate a past stock fraud network that included Mr. Possino, Mr. Possino's current activities "suggest he may be involved in a new network involving stock deals and promotions." As recently as December 1999, Idaho securities regulators obtained a judgment and injunction in a Boise State court against a company they said was owned by Regis Possino. The regulators alleged that the Possino-owned company and one of its salesman misled investors in the selling of two stocks that produced more than $150,000 of losses for the buyers. Possino and company failed to mention that the shares being offered were controlled by Mr. Possino or that one of the stocks had already been at the center of an SEC manipulation lawsuit. The judgment came after the Company didn't respond to the suit.

With such characters promoting Ziasun's stock it was no wonder that Continental Capital & Equity (Who's owner John Manion at the time had ties to the Russian Mob and shortly there after was sent to prison for securities fraud) Ziasuns third IR Company proudly profiled Ziasun and claimed that Ziasun had received an INDEPENDENT buy recommendation from Access1financial with a remarkable $36 price target within 12 months. Continental Capital & Equity also had ties to Possino. which also promoted ESAT Inc stock Later it would be found in numerous class action suits where Mr. Bergman had written buy reports for that his defense was that the companies themselves gave him the information and that his buy reports where just advertisements for the companies and that the companies themselves provided the information.

So known criminals are writing buy reports with unheard of price targets. Nothing stops Ziasun. Ziasun decided to put out there own press release touting the INDEPENDANT buy report. ziasun.com
As investors know now the report was bogus. Ziasun pulled the wool over the average investors eyes claiming that the report was INDEPENDANT, which it was not.

Access1Financial also wrote a similar paid advertisement for Chequemate International Inc. which Mr. Bergman had put a price target of $24 on the paid advertisement. This did not stop Chequemate International Inc. from putting out a press release stating that their company had received a buy recommendation from INDEPENDENT ANALYST Access1Financial with not even a honorable mention that the buy report was paid for and was in reality an advertisment.. c3ddigital.com

In the actual disclaimer (which I have a copy) it was not clear as to how many shares of Chequemate International Inc. Access1financial was to receive for this advertisement. The disclaimer stated that they would be paid 25,000 to 75,000 shares of Chequemate International Inc. stock for investor relations. (Future Information Upon Request). In many such disclaimers I have seen the paid promoter is paid on a sliding scale and is compensated by how high the stock can go after the report is put out. In Chequemate International Inc case the stock rocketed from about $7to $17.50 on huge volvume right after they had a reverse 1 to 4 stock split. DDD closed today at 17 cents.

Today Regis Possino has found a new home. According to a story in the Format he is running the daily affairs of Adnan Khashogi's ( Yes, the arms dealor) bank which according to the format is being run by criminals. You do not get CD's at this bank. They are selling reg "S" shares on highly questionable companies on the otcbb. Regis allstars at Khashogi's bank include

Raxesh Saxena is rumoured to have contributed to the Billion bankruptcy of the Bangkok Bank of Commerce ($2.4B damage, accused by thai authorities).

A U.S. citizen named "Regis Possino" is running daily affairs of the bank, international reports call Possino a californian ex-lawyer who has been abolished due to drug trafficking & fraud.

The finder of the deal appears to be "Raoul Bertha(u)mieu", a canadian citizen, who took over a seat on WMPs board a longer time ago. Berthamieu has been convicted under check fraud. His nickname is "Lee Sanders", his newest company is named "Pacific Federal, Inc."

"Global Capital Partners" is the dominating shareholder in "WMP" according to reports.

GCAP, WMP and others are accused of pumping weak stocks.

One such stock Khashogi's bank is pushing is Castpro which name was changed to Thoan Communications. The link was quickly taken down by them once Internet posters had found out that Regis Possino the criminal was involved and started posting about it on ragingbull. I did save the link and It still works. Castpro was also connected to Ziasun. In another promotional advertisement touting Castpro by Steven Reid who also wrote a buy report which was a paid advertisement on Ziasun he had stated he had witnessed a teleconference where Ziasun had used Castpro's technology. In Mr Reid's disclaimer he stated that he was paid by a third party. After pressuring him with emails Steven Reid finally admitted that Ziasun's IR company had paid them and that they where the third party. How a companies IR company can be considered a third party is beyond me since an IR company is representing the company. When asked which IR company paid him since Ziasun had had three IR companies he emailed back and stated that he had to talk to his attorney and that I was harassing him.

Alan Phan of Hartcourt companies fake PHD. One of Regis Possino's first scam frauds was Hartcourt. I have it all documented mind you. Now Regis had to see to it that Alan Phan the front of the stock rig had a good title. They needed an important title for his resume like "Doctor" so this is the TRUTH ABOUT HIS DEGREE.

"Sussex College of Technology, Sussex, England. Perhaps the oldest of
Britian's degree mills, Sussex is run by "Dr." Bruce Copen from his
home, south of London. At the same address, but with different
catalogs are the Brantridge Forest School and the University of the
Science of Man. Each offer "earned" degrees for which a few
correspondence are required, and "extension awards" which are the same
degrees and diplomas for no work at all. Honorary Doctorates are
offered free, but there is a $100 engraving charge. "Professor
Emeritas"[sic] status costs another $100. One flyer admits Sussex

If/When it was clear to both of us that Derek didn't earn a PhD
at a bona fide school, my assumption has been that these negotiations
would likely go into a mode where you would just ignore/stall. It
appears that is now the case. So, there were a couple of loose
ends I'd like to try to clean up. First, list all the diploma mills
in Bear's book. Secondly, a note that may be of personal interest
to you and a preview copy of an update to my web page.
I collected the list of PhD scam diploma mills from Bear's book
that I mentioned to you previously. These are from his chapter 25
that I also mentioned in the same previous post. Here's some
detail Dr. Bear gives for one diploma mill, as an example.
"Sussex College of Technology, Sussex, England. Perhaps the oldest of
Britian's degree mills, Sussex is run by "Dr." Bruce Copen from his
home, south of London. At the same address, but with different
catalogs are the Brantridge Forest School and the University of the
Science of Man. Each offer "earned" degrees for which a few
correspondence are required, and "extension awards" which are the same
degrees and diplomas for no work at all. Honorary Doctorates are
offered free, but there is a $100 engraving charge. "Professor
Emeritas"[sic] status costs another $100. One flyer admits Sussex
is not "accrediated" [sic] but goes on to say that "No student who
has taken our courses and awards have to date had problems." This
statement would not be accepted by, among many others, a former
high-level state official in Colorado who lost his job when the
source of his Doctorate was discovered. Sussex continues to advertise
extensively in newspapers and magazines in the U.S. and worldwide.
In 1988, a new British law came into effect, forbidding such "schools"
to accept students who enrolled after May 1st. Sussex's solution to
this minor annoyance was to offer to back-date all applications to
April 30th, 1988 - a creative response that British law apparantly
hasn't caught up with yet."
The following list is not claimed to be complete. The nature of this
type scam would make that almost impossible. Also, it is apparantly
very common for the con artists to slightly change the name of their
"school" from time to time. They also sometimes like to try to pick
names that are very close to accredited schools. I assume that
Derek's PhD was purchased from one of these "schools", if so then,
his PhD is a fraud and in that case I wouldn't really expect to hear

Derek Smart, author of a mediocre computer game called Battlecruiser
3000ad (BC3K), is widely known on Usenet as being the focus of the
largest and longest running flame-fest ever seen, this occurs primarily
in the comp.sys.ibm.pc.games.strategic (c.s.i.p.g.s.) news group.
INTRODUCTION
Derek Smart has claimed to have a PhD in almost every post he's made
over the past few years. Prior to the PhD wars (8/8/97 - present),
whenever anyone had asked about details he was strangely silent. The
biggest braggart many have ever seen being silent on such occasions
seemed very "out of character". This coupled with my observation of many
months of Derek lies, lead me to suspect that Derek's PhD was a fake.
After gathering further evidence, it's believed this is now an
inescapable conclusion.
Here's some things Derek has said about his studies. He has said that he
studied only part time. He's said that he studied in the USA and England.
He's said that it was a mail order college. He's more recently said his
school is in England. He's stated it wasn't important whether his school
was accredited or not. He's said it's a renowned accredited college. He's
said it's a small tech institute. He's said he grew up in England and
moved to the USA in 1989.SUMMARY
This presentation argues that Derek's PhD is a fraud. It consists of
four firmly established facts. These facts taken together, show that his
PhD is a probable fraud. Derek has not earned a PhD at any accredited
university.FACT 1: Derek Smart's PhD dissertation is not listed anywhere.
(Almost all PhD dissertations are listed in DAI or somewhere.)
FACT 2: Derek has not provided simple information.
(Derek hasn't named his alma mater, among other things.)

I found your proposed amendments offensive and fallacious. I can prove
Derek's Ph. D. any time I wish by revealing this information. I am,
however, awaiting a certification from the registrar which I will
provide to Charles Curran, Esq. and/or Whowhere (and also to annex to a
federal complaint if need be).
To say that "negotiations continued on for over a month and it seemed
that the lawyer's position just kept crumbling more and more." is also
false. We have not been negotiating for over a month. Our negotiations
were limited to the nature of proof that would be acceptable to both
parties which was agreed from close to the outset. The fact that I have
been waiting for a certification has no bearing whatsoever on the
underlying merits, and does not constitute negotiations. If you feel
that you do not want to wait for me to provide this information, that is
your choice.
Your "conclusion" that Derek received his Ph. D. from a "Ph. D. mill" is
false and defamatory.
You are also categorically incorrect by stating that the onus is on
Derek to prove his Ph. D. He doesn't have to prove anything until he
files suit. At that time, you will be held accountable for what youpost.
If your intent was to further antagonize Derek and annoy me, you have
succeeded. Your web page is defamatory as it is. If you amend it
further to include the material in your message to me, I will recommend
to Derek that we go forward and file suit.
My approach to practicing law is that a good lawyer keeps his client out
of court. This approach works when the parties are reasonable.
However, your web page as well as the history of your posts demonstrate
that you are on a personal crusade to villify Derek. I do not believe
that the courts will protect this "speech". If you continue on this
path, I do not see any alternative than litigation. If you amend your
web page, I will take it as a rejection of my attempt to resolve this
matter, and I will take appropriate action.
