That guy could get in trouble for some of his statements: 1. is going to $6 in 90 days--I think this statement is okay because analysts frequently set targets for a specific time period, usually 12 to 18 months. 2. Performance of last 3 oil/gas picks--Okay if the statement is true. 3. 1170 subscriber millionairs--okay if true, but how is he going to know. 4. new pick may be all time pick--hype but it does say "may" 5. Historical information on the stock has to be accurate. Bottom line I would never buy an OTC:BB stock let along on a tip, but there's a big difference between what this tout is saying and fraud. Even if he owns the stock he is touting, there may be a disclosure requirement, that brokerages also put in the fine print of their "research" reports that says they own shares. So as long as this guy makes the proper disclosures, (which he has at the bottom), he's covered and in the clear from fraud accusations.
