If a job doesn't produce the value of the minimum wage, either the job doesn't get done, or the employer and employee conspire to break the law

You've left one element out of the equation. The employer can raise prices enough to get the extra value out of the job and we all end up paying a little bit of the additional wages. The state doesn't expect the employer to lose money but rather to raise prices. The state sees the minimum wage as a market solution to a welfare problem--sharing the cost of this job through higher prices or rather than through taxes for additional welfare payments.
